Alec Baldwins attorney slams prosecution after gun enhancement charges dropped in ‘Rust’ shooting On Tuesday.
Alec Baldwin’s defense attorneys withdrew their motion challenging the gun enhancement charges that were dropped from the criminal charges by prosecutors in New Mexico. However, they did not do so without a few pointed words for their adversaries.
Monday, the Santa Fe District Attorney’s Office made the announcement that the gun enhancement charge against Baldwin in the shooting death of cinematographer Halyna Hutchins on the set of “Rust” in October 2021, which would have resulted in a five-year prison sentence, had been dropped.
The special prosecutor’s description of Baldwin’s attorneys as “fancy lawyers” attempting to “distract” from the case was the target of the defense notice to withdraw.
“By repeatedly giving interviews on national television in which they erroneously claimed that the enhancement was not, members of the prosecution team had amplified the error in the Original Information.”

only applicable to Mr. Baldwins, but mandatory, and Mr. Baldwin was facing an additional five years in prison as a result,” said defense attorney Luke Nikas. “They erroneously claimed that Mr. Baldwin was facing an additional five years in prison as a result of the enhancement.”
Nikas contained a number of emails from special prosecutor Andrea Reeb, one of which threatened sanctions and accused the defense of not following proper procedures. A subsequent email reversed course.
“I completely concur with your assessment of the situation. The email from February 12 stated, “I will have our documents drafted to amend the criminal information to remove the firearm enhancement and file something withdrawing the firearm enhancement.”
Reeb filed the amended charging document, which dropped the enhancement, more than a week later, on February 20.
For the shooting, Baldwin is still charged with involuntary manslaughter; however, if he is found guilty, the sentence for that crime would be reduced to 18 months.
His most memorable court appearance, virtual, is booked for Friday.
